Please read these Terms of Service carefully before using MyProtektor. By creating an account or accessing any part of our platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and MyProtektor governing your access to and use of the MyProtektor web application, mobile application, application programming interfaces, and all related services (collectively, the "Service"). The Service is operated by Mike Roth, Founder, Michael-Gaismayr-Strasse 52b, 6900 Bregenz, Austria, European Union ("MyProtektor," "we," "us," or "our").

By registering an account, accessing any feature, or continuing to use the Service after changes to these Terms have been published, you signify your acceptance. These Terms apply to every user regardless of their assigned role within the platform, including Owners, Admins, Guards, Clients, and LiteClients.

These Terms incorporate by reference our Privacy Policy, Acceptable Use Policy, Cookie Policy, and any other policies published on our website. In the event of a conflict between these Terms and any supplementary policy, these Terms shall prevail unless the supplementary policy expressly states otherwise.

2. Platform Description

MyProtektor is a cloud-based security guard management platform designed for professional security firms operating across Southern Africa. The Service provides a comprehensive suite of tools that enable security companies to manage their daily operations, respond to emergencies, and deliver transparent reporting to their clients.

2.1 Core Capabilities

  • Incident Reporting and Management: Create, document, review, and resolve security incidents with photographic evidence, GPS coordinates, severity classifications, and time-stamped audit trails
  • Live GPS Guard Tracking: Monitor the real-time geographic position of on-duty security guards, review historical movement data, and verify physical presence at assigned locations
  • Emergency Panic Alerts: Allow guards and clients to trigger instant emergency notifications that are forwarded to designated personnel within your organisation along with the sender's precise GPS coordinates
  • QR Patrol Verification: Deploy cryptographically signed QR codes at physical checkpoints that guards scan during patrols to provide tamper-proof evidence of route completion
  • Client Transparency Portal: Grant protected clients read-only access to published incident reports, guard activity summaries, and security analytics for their properties
  • Multi-Site Management: Organise security operations across multiple physical locations under a single organisational account with site-specific configurations
  • Analytics and Reporting: Generate operational performance dashboards, incident trend analyses, patrol compliance summaries, and exportable reports in CSV and PDF formats

2.2 Platform Availability

The Service is accessible through a web dashboard at www.myprotektor.co.za and through dedicated mobile applications for Android and iOS devices. Feature availability may differ between the web and mobile versions and may vary by subscription tier.

2A. Service Classification

MyProtektor is designed and intended to operate as a software-as-a-service (SaaS) information technology platform, developed and operated from Austria, European Union.

MyProtektor is not intended to provide security services as defined in the Private Security Industry Regulation Act 56 of 2001 (PSIRA Act). In particular, MyProtektor does not:

  • employ, manage, or supervise security personnel;
  • provide armed or unarmed response services;
  • itself operate a security control room, monitoring centre, or response service;
  • dispatch response personnel to incidents or emergencies;
  • monitor signals or transmissions from alarm or electronic security equipment;
  • guarantee any response time or intervention outcome.

All security services, including guard deployment, armed response, and incident intervention, are provided exclusively by independently licensed security companies using the platform. These companies operate under their own PSIRA licences and are solely responsible for all security service delivery, personnel management, and regulatory compliance.

3. User Accounts and Authentication

3.1 Eligibility

To create an account on MyProtektor, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are registering on behalf of a legal entity such as a security company, you represent and warrant that you have the authority to bind that entity to these Terms.

3.2 Account Registration

  • You must provide accurate, current, and complete information during the registration process
  • You are responsible for maintaining the accuracy of your account information at all times
  • Each natural person may maintain only one account on the platform
  • Organisation Owners may invite additional users and assign roles within their organisation

3.3 Authentication and Security

  • You are solely responsible for safeguarding your login credentials, including passwords and any multi-factor authentication tokens
  • You must not share your account credentials with any other person or allow another individual to access the Service through your account
  • You must notify us immediately if you become aware of any unauthorised access to or use of your account
  • We support multiple authentication methods including email and password, phone number, Google Sign-In, and Apple Sign-In

3.4 Role-Based Access

MyProtektor implements a hierarchical five-role permission system. Each role carries specific privileges and responsibilities:

  • Owner (Level 4): Full organisational control including billing, subscription management, user administration, and all operational features
  • Admin (Level 3): Guard and client management, incident approval and publishing, site configuration, QR code generation, and reporting
  • Guard (Level 2): Incident reporting with photo evidence, QR patrol scanning, GPS location sharing during shifts, and panic alert activation
  • Client (Level 1): View published incidents for their properties, access security reports, and use emergency features
  • LiteClient (Level 0): Panic alert activation, view incidents in their vicinity, and receive push notifications for area alerts

3.5 Account Responsibility

You accept full responsibility for all activities that occur under your account, whether or not you have authorised such activities. MyProtektor shall not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscription and Billing

4.1 Subscription Plans

MyProtektor offers multiple subscription tiers for security firms and a separate subscription for LiteClient users. Each plan includes a defined set of features and user limits. Full plan details, including current pricing in South African Rand (ZAR), are published on our website and within the application.

  • Security firm plans are available on monthly and annual billing cycles
  • LiteClient plans are billed on a monthly cycle
  • Custom enterprise plans are available by arrangement for larger organisations

4.2 Free Trials

Certain subscription plans may include a free trial period. During the trial, you have access to the features of the selected plan at no charge. At the end of the trial period, your chosen payment method will be charged automatically unless you cancel before the trial expires. Trial eligibility is limited to one trial per organisation.

4.3 Payment Processing

  • All payments are processed securely through Stripe, our third-party payment provider
  • By subscribing, you authorise us to charge the payment method you provide on a recurring basis according to your selected billing cycle
  • All prices are quoted in South African Rand (ZAR) and are inclusive of applicable taxes unless otherwise stated
  • You are responsible for ensuring that your payment method remains valid and has sufficient funds to cover subscription charges

4.4 Plan Changes and Add-Ons

  • You may upgrade or downgrade your subscription at any time through the account settings
  • Upgrades take effect immediately, with a prorated charge for the remainder of the current billing period
  • Downgrades take effect at the start of the next billing period
  • Add-on features such as additional user seats, patrol point bundles, or extra panic button credits may be purchased separately and are billed according to their stated pricing

4.5 Failed Payments

If a scheduled payment fails, we will attempt to process the charge again within a reasonable period. If payment cannot be collected after repeated attempts, we may suspend your access to the Service until the outstanding balance is settled. Emergency features will not be restricted during a grace period for safety reasons.

4.6 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Upon cancellation, your access to paid features continues until the end of your current billing period
  • Monthly plans: Can be cancelled anytime; access ends at the close of the current billing cycle
  • Annual plans: Non-refundable after the first 14 days. If cancelled, access continues until the end of the paid twelve-month term. Annual plans renew automatically unless cancelled at least 30 days before the renewal date
  • Refunds are handled in accordance with our Refund & Cancellation Policy, which is available as a separate document on our website
  • Charges for usage-based add-ons that have already been consumed are not refundable

5. Permitted Use

The Service is provided exclusively for lawful security management purposes. You agree to use the Service only for:

  • Managing legitimate security operations for your organisation or properties
  • Reporting genuine security incidents and emergencies
  • Coordinating guard patrols, schedules, and assignments
  • Communicating with team members and clients about security matters
  • Generating operational reports and analytics for business purposes
  • Training security personnel on platform features and operational procedures

Detailed rules regarding acceptable and prohibited conduct are set out in our Acceptable Use Policy, which forms part of these Terms.

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes in detail how we collect, use, store, and protect your personal information, including location data, incident records, and device information. By using the Service, you acknowledge and consent to the data practices described in our Privacy Policy.

You retain ownership of all data you submit to the Service. By uploading data, you grant MyProtektor a limited, non-exclusive licence to process, store, and display that data solely for the purpose of providing and improving the Service. This licence terminates when you delete your data or close your account, subject to any legal retention obligations.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including all software, algorithms, user interfaces, designs, text, graphics, logos, trademarks, and documentation, is the proprietary property of MyProtektor or its licensors. All rights not expressly granted in these Terms are reserved.

  • You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Service without our prior written consent
  • You may not reverse-engineer, decompile, or disassemble any component of the Service
  • The MyProtektor name, logo, and all related marks are our exclusive property

7.2 Your Content

  • You retain all ownership rights in content you create and upload to the Service
  • You represent and warrant that you have all necessary rights to any content you upload, including photographs, video recordings, and written descriptions
  • You may export your data at any time using the export features provided in the Service

7.3 Feedback

If you provide us with suggestions, ideas, or feedback regarding the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free licence to use, modify, and incorporate such feedback into the Service without any obligation to you.

8. Service Availability and Uptime

8.1 Availability Target

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance, which we will communicate in advance where practicable
  • Urgent or emergency maintenance required to address security vulnerabilities or critical system failures
  • Circumstances beyond our reasonable control, including internet outages, natural disasters, or third-party service disruptions

8.2 Alert and Notification Delivery

The delivery of panic alerts, notifications, and location updates depends on factors beyond MyProtektor's control, including mobile network availability, device battery status, operating system restrictions, push notification service availability (Google FCM, Apple APNs), and recipient device settings. MyProtektor does not guarantee the delivery, receipt, or timeliness of any alert or notification.

8.3 Support

  • Technical support is available during standard business hours via email
  • Critical security emergencies receive priority handling
  • Response times depend on your subscription tier and the severity of the issue
  • Support is provided in English

9. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of South Africa:

  • Cap on Liability: Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service shall not exceed the lesser of (a) the total fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty thousand South African Rand (R50,000)
  • Exclusion of Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or damage to reputation, regardless of whether we were advised of the possibility of such damages
  • No Warranty: The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Security Disclaimer: MyProtektor is a management and coordination tool. We do not provide physical security services, and we do not guarantee the prevention of security incidents, crimes, or emergencies. The effectiveness of security operations depends on the personnel, procedures, and equipment deployed by your organisation

10. Indemnification

You agree to defend, indemnify, and hold harmless MyProtektor, its founder, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of or access to the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of the rights of any third party
  • Any content you submit, post, or transmit through the Service
  • The security operations and decisions made by your organisation using the Service

11. Termination

11.1 Termination by You

  • You may close your account and terminate these Terms at any time by contacting us or using the account deletion feature in your settings
  • Your subscription will remain active until the end of the current billing period
  • We recommend exporting any data you wish to retain prior to account closure, as data may be permanently deleted after a reasonable retention period

11.2 Termination by Us

  • We may suspend or terminate your access to the Service immediately and without prior notice if you materially breach these Terms or our Acceptable Use Policy
  • We may terminate your account if your subscription payment remains outstanding for more than thirty (30) days following the due date
  • We may discontinue the Service entirely upon giving at least sixty (60) days' written notice to all registered users

11.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately except for any remaining prepaid subscription period. Provisions of these Terms that by their nature should survive termination shall continue in force, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the version number and effective date at the top of this document. For material changes, we will provide notice through one or more of the following methods:

  • Email notification to the address associated with your account
  • A prominent notice within the Service interface
  • Publication of the revised Terms on our website

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must discontinue your use of the Service and close your account.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of the Republic of South Africa for the resolution of any dispute arising out of or relating to these Terms or the Service.

MyProtektor is operated from Austria. Where applicable, European Union regulations including the General Data Protection Regulation (GDPR) may apply in addition to South African law.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us in writing. We will endeavour to reach a mutually satisfactory resolution within thirty (30) days of receiving your written complaint.

14.2 Mediation

If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by a mutually agreed mediator in South Africa. The costs of mediation shall be shared equally between the parties unless the mediator directs otherwise.

14.3 Litigation

If mediation does not resolve the dispute within sixty (60) days, either party may pursue the matter through the courts of the Republic of South Africa as set out in Section 13 above.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, Acceptable Use Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and MyProtektor regarding the Service
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction
  • Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, pandemics, power outages, or internet disruptions
  • Notices: All legal notices to us must be sent in writing to the email address listed in Section 16. Notices to you will be sent to the email address associated with your account

Service Limitations

MyProtektor is a software platform for the coordination and documentation of security-related operations. It is not a provider of security, armed response, emergency, or dispatch services, and no feature of the platform shall be construed as a guarantee of intervention, availability, or response time. In any emergency situation, the responsible public emergency services must be contacted directly.
